How does the Universal Declaration of Human Rights and the European Convention on Human Rights work in the United Kingdom?
Well, with the exception of the European Convention on Human Rights being decided at the European Court of Human Rights, Human Rights are hard to rely on directly in the United Kingdom.
Human Rights Act 1998
This statutory legislation in effect makes the European Convention on Human Rights law.
There are however, major flaws in this Act:
- Only applies to Government bodies; Human Rights violations are excluded against private businesses, public companies and individuals unless such is part of another statutory law or common law.
- Not all the European Convention on Human Rights articles are included.
- Generally, legislation displaces this Act. If a law conflicts with an right contained in the European Convention on Human Rights, the law takes presence and it is rare to be able to rely on the Human Rights.

- Everyone is bound by the law (as expected), Human Rights follow on loopholes or elements where the laws don’t cover, as second. Human Rights are frequently infringed by law whereas this law can’t be relied on.
